Family Tree Photo Terms of Use (Android)

Effective date: 15 October 2026

Welcome to Family Tree Photo!

By accessing and using Family Tree Photo, you agree to be legally bound by these Terms. Please read the Terms carefully. If you do not agree with one or more provisions of these Terms, you should not use Family Tree Photo.

1. GENERAL INFORMATION

1.1. These Family Tree Photo Terms of Use (the “Terms”) constitute a legally binding agreement between an individual user (the “user”) accessing and using the mobile application Family Tree Photo and the related services (collectively, “Family Tree Photo”) and Željko Paić having a business address at Gornja Puharska bb, Prijedor, Bosnia and Herzegovina (“we”, “us”, and “our”).

1.2. About Family Tree Photo. Family Tree Photo is a mobile application that allows the user to build a family tree containing images of family members, export the family tree and the family members’ stories as PDF files, and save them on user’s mobile device, share them, or print them out. This version of Family Tree Photo is compatible with the Android operating system and is available for download via Google Play.

1.3. License to use Family Tree Photo. We grant the user a personal, revocable, non-exclusive, non-commercial, non-transferable and limited license to use Family Tree Photo pursuant to these Terms. The user is not allowed to use Family Tree Photo in countries where it may be restricted or prohibited by local legislation.

1.4. Minors. Family Tree Photo is not marketed and should not be used by persons under the age of 18. If a person under the age of 18 but older than 13 would like to use Family Tree Photo, that person has to obtain consent from a parent or legal guardian prior to using Family Tree Photo. Children under the age of 13 are not allowed to use Family Tree Photo in any manner, with or without consent from their parents or legal guardians. If a parent or legal guardian becomes aware that Family Tree Photo is used by (i) a minor under the age of 13 or (ii) a minor between the ages of 13 and 18 without the said consent, the parent or legal guardian of that child can contact us and request us to delete any content uploaded by the child.

1.5. Disclaimer. All information provided on Family Tree Photo is for general information purposes only; it does not constitute technical or expert advice. Although we regularly monitor Family Tree Photo, we cannot guarantee the accuracy, reliability, currency, relevance, and completeness of any information available on Family Tree Photo.

1.6. Third-party links. Family Tree Photo may contain links to websites, services, and other online sources owned and operated by third parties. We are not responsible or liable in any manner for the content of such third-party links, as well as the security and privacy practices deployed by the operators of third-party websites and services. The user is requested to exercise due diligence before clicking on any third-party links.

1.7. Support. Any requests for customer or technical support should be addressed to us by email at familytreephotoapp@gmail.com.

1.8. Privacy and other relevant terms. The documents that include important provisions regarding user’s access and use of Family Tree Photo and should be read and interpreted together with these Terms are:

  • Our privacy policy, which describes in detail how we handle users’ personal data collected and processed through Family Tree Photo; and

  • Other individual terms and conditions made available by us through Family Tree Photo.

1.9. User’s warranties. By accessing and using Family Tree Photo, the user acknowledges, agrees, and warrants that the user:

  • Will comply with these Terms and all applicable local, state, national and foreign laws, treaties, and regulations;

  • Will provide only true, accurate, complete, and up-to-date information, including personal data;

  • Can conclude legally binding contracts with us; and

  • Is not under any type of judicial interdiction.

2. FEES AND PAYMENTS

2.1. Free of charge. Family Tree Photo for Android is available for download via the online marketplace Google Play completely free of charge. All features and functionalities of Family Tree Photo are available to the user without any in-app purchases, subscriptions, or other fees, and Family Tree Photo does not display advertisements.

2.2. Additional fees. The user is solely responsible for paying all fees related to purchasing carrier data plans, Internet service subscriptions, computing equipment, and other fees and taxes associated with user’s access and use of Family Tree Photo.

2.3. Google Play. The user is responsible for maintaining a user account in Google Play and for complying with the then-current terms and conditions of Google Play when downloading and updating Family Tree Photo.

3. USER-GENERATED CONTENT

3.1. While using Family Tree Photo, the users may submit photographs, names, and other details about them and their family members (collectively, the “User-Generated Content”). The User-Generated Content is stored locally on user’s mobile device. Some of the User-Generated Content may become visible and accessible to third parties if the user exports, shares, or prints it (for example, as a PDF file or a backup file). Therefore, we request the users to: (i) exercise their due diligence when uploading the User-Generated Content onto Family Tree Photo; (ii) not to make publicly available any sensitive information; and (iii) make sure that, by uploading the User-Generated Content onto Family Tree Photo, the user complies with these Terms.

3.2. By uploading the User-Generated Content to Family Tree Photo, the user grants us unrestricted, worldwide, sub-licensable, royalty-free, perpetual, and irrevocable rights to use the User-Generated Content for the purpose of providing Family Tree Photo. We will not access, use or distribute the User-Generated content outside what is necessary to provide Family Tree Photo.

3.3. The user agrees not to submit the User-Generated Content that violates these Terms or any applicable laws, including privacy, confidentiality, and intellectual property rights of others.

3.4. The user understands and agrees that, in order to ensure the security Family Tree Photo, we may, but have no obligation to, monitor or review the User-Generated Content. We reserve the right, at our sole discretion, to refuse to upload, modify, delete, or remove the User-Generated Content, in whole or in part, that violates these Terms or may harm the reputation of Family Tree Photo. However, the users remain solely responsible for their User-Generated Content.

3.5. We do not control how users handle User-Generated Content and accept no responsibility regarding the User-Generated Content that is used outside Family Tree Photo. For example, we are not responsible in any manner for the use of the images of family trees after such images are downloaded and saved to user’s mobile device. The user is solely responsible for ensuring that such family tree images are used and distributed in a legitimate manner.

4. FAMILY MEMBER’S DATA

4.1. The user must obtain permission from living family members to upload any information about those family members to Family Tree Photo. The user is not allowed to use personal data of living persons who have not provided the user with their prior authorisation or consent to share their personal data (e.g., the user cannot publish names and photographs of a family member who has not allowed the user to do so). It is user’s sole responsibility if the user fails to comply with the said obligation.

4.2. If there is a complaint about any User-Generate Content published without family member’s consent or against that person’s wish, we suggest the damaged party to contact the user who has uploaded the User-Generated Content. We do not store or have access to the User-Generated Content. Therefore, we cannot delete the User-Generated Content on Family Tree Photo.

4.3. The user is not allowed to copy any photos or other information from external third-party family tree websites, applications, and services, without obtaining the necessary permission of the respective owners of that content.

5. ACCEPTABLE USE POLICY

5.1. When using Family Tree Photo, the user is required to follow our acceptable use policy outlined in this Section 5. Please be advised that we work closely with law enforcement and we report any inappropriate content that may infringe applicable laws.

5.2. The user is not permitted to use Family Tree Photo in any manner that substitutes or contributes to the following activities (the list is representative and not exhaustive):

  • Any unlawful activity, including violation of any laws, statutes, ordinances, or regulations;

  • Dissemination of any content which the user does not own or have rights to;

  • Infringement of property or intellectual property rights, including trademarks and copyright;

  • Fraud;

  • Provision of false, inaccurate, or misleading information;

  • Impersonation or misinterpretation of identity;

  • Sexually explicit, libellous, harassing, defamatory, abusive, profane, vulgar, threatening, hateful, obscene behaviour and terrorism-related content;

  • Provision of photographs and personal data without living individuals (other than the user’s) consent;

  • Provision of any information relating to minors, which identifies them, provide personal details, or allow to communicate with them, without the direct consent of their parent or guardian;

  • Dissemination of information about the acts, including pranks and challenges, that may result in injuries, physical harm, or distress to children;

  • Posting of content that depicts, links to, or incites others to commit acts of violence;

  • Gambling, including contests, lotteries, games of chance, bidding fee auctions, sports forecasting or odds making, Internet gaming, fantasy sports leagues with cash prizes, and sweepstakes;

  • Spreading of malware (e.g., viruses, worms, Trojan horses), spam, and other illegal messaging;

  • Spreading ethnically, racially, or otherwise objectionable information;

  • Advertising or encouraging the use of tobacco, alcohol, and any illegal substances;

  • Dissemination of any type of commercial messages, marketing, and advertising material;

  • Copying, distributing, renting, reselling, modifying, compromising, damaging, disabling, impairing, and overburdening Family Tree Photo;

  • Interfering with or abusing other users of Family Tree Photo;

  • Using bots, scripts, and other automated methods;

  • Collecting and disclosing any information about the users of Family Tree Photo;

  • Harming our or Family Tree Photo’s reputation; and

  • Infringement of any provision of these Terms.

5.3. Reporting inappropriate content. If the user has a reason to believe that some of the content available on Family Tree Photo is inappropriate, infringes these Terms, applicable laws, or the rights to privacy, the user is kindly asked to contact us immediately at familytreephotoapp@gmail.com. Since the User-Generated Content is stored only on users’ devices, we will assist, to the extent technically possible, in addressing any content reported as inappropriate.

6. SECURITY

6.1. We take appropriate security measures, such as strong passwords and limited access to personal data by our staff, to protect any information that we process in connection with Family Tree Photo against unauthorised access. The User-Generated Content is stored locally on user’s mobile device, and the user is responsible for protecting access to the device and for keeping backup copies of the User-Generated Content.

6.2. Avoiding phishing and scam. Phishing is an online scam that aims to trick someone into giving up their personal data, such as credit card numbers, social security/national ID numbers, or other financial data. Usually, when scammers have that information, they will then use it to steal people’s money, property or identity. The user agrees not to disclose any financial information through Family Tree Photo. We make no representations or warranties as to the conduct of the users of Family Tree Photo.

6.3. Security incidents. Given the nature of communications and information processing technology and the Internet, we cannot be liable for any security incidents, cyber attacks, data breaches, and unlawful destruction, loss, use, copying, modification, leakage, and falsification of any information caused by circumstances that are beyond our reasonable control. In case a security incident occurs, we will inform relevant authorities without undue delay and immediately take reasonable measures to mitigate the incident, as required by the applicable law. Our liability for any security incidents will be limited to the highest extent permitted by the applicable law.

7. INTELLECTUAL PROPERTY

7.1. Family Tree Photo Content. Most of the content made available on Family Tree Photo, excluding the User-Generated Content, is owned by us, our partners, agents, licensors, vendors, and/or other content providers (the “Family Tree Photo Content”). The Family Tree Photo Content includes, but is not limited to, text, images, audiovisual content, source code, trademarks, service marks and trade names. The Family Tree Photo Content is protected by the applicable intellectual property laws and international treaties. Unless it is strictly necessary for translation and contribution purposes, the user is not allowed, without obtaining prior written authorisation from us, to:

  • Copy, distribute, and make available the Family Tree Photo Content to third parties;

  • Disassemble, make alterations, decompile, reverse engineer, translate, and adapt the Family Tree Photo Content;

  • Distribute, rent, loan, use, lease or attempt to grant other rights to the Family Tree Photo Content to third parties; and

  • Use any manual or automated means to scrap any content available on Family Tree Photo.

7.2. Third-party intellectual property. Some of the intellectual property assets, such as the User-Generated Content and the trademarks of third-party services, featured on Family Tree Photo may be owned by the users of Family Tree Photo and other third parties. Such third-party intellectual property does not belong to us and it remains the sole property of the respective third-party proprietors.

7.3. Copyright infringement claims. We respect intellectual property rights. If the user has any grounds to believe that any content made available on Family Tree Photo violates user’s or third party’s intellectual property rights, we request the user to contact us and express user’s concerns or request us to remove the allegedly infringing content (our contact details are available at the end of the Terms). In the copyright infringement claim, please provide sufficient details allowing us to locate the allegedly infringing content on Family Tree Photo. We will reply to the copyright infringement claim as soon as possible but no later than 2 weeks.

8. AVAILABILITY

8.1. We put reasonable efforts to ensure that Family Tree Photo is accessible at all times. However, the availability of Family Tree Photo may be affected by factors, which we cannot reasonably control, such as bandwidth problems, equipment failure, acts and omissions of our third-party service providers, or force majeure events. We take no responsibility for the unavailability of Family Tree Photo caused by such factors.

9. DISCLAIMER OF WARRANTIES

9.1. We provide Family Tree Photo on “as available”, “as is”, and “with all faults” basis. To the extent permitted by the applicable law, we do not make any representations or warranties about the reliability, suitability, and accuracy, for any purpose, of Family Tree Photo, any content featured on Family Tree Photo, whether provider by us, the users, or third parties, and hereby disclaim all warranties regarding Family Tree Photo and its operation.

9.2. It is user’s sole responsibility to verify and assess the fit for the purpose of Family Tree Photo prior to using it and to decide whether or not Family Tree Photo fits for the intended use.

9.3. By using Family Tree Photo, the user acknowledges that we may use third-party suppliers to provide software, hardware, storage, networking, and other technological services. The acts and omissions of third-party suppliers may be outside of our reasonable control. To the maximum extent permitted by law, we exclude any liability for any loss or damage resulting from the acts and omissions of such third-party suppliers.

9.4. Nothing in these Terms shall affect any statutory rights that the user is entitled to as a consumer and that the user cannot contractually agree to alter or waive.

10. LIMITATION OF LIABILITY

10.1. Unless otherwise excluded or limited by the applicable law, we will not be liable for any damages, including, but not limited to, incidental, punitive, special or other related damages, arising out or in connection with user’s use of Family Tree Photo or any content made available through Family Tree Photo. The user agrees not to hold us liable in respect of any losses arising out of any event or events beyond our reasonable control.

10.2. We will not be liable to the user for any direct, indirect or consequential losses, which may be incurred by the user in relation to Family Tree Photo, such as:

  • Any health issues, cases of injuries and death experienced as a result of the use of Family Tree Photo;

  • Direct and indirect loss of profits;

  • Loss of goodwill or business reputation;

  • Loss of opportunities; and

  • Loss of data.

10.3. We will not be liable to the user for any loss or damage, which may be incurred by the user as a result of:

  • Any changes which we may make to Family Tree Photo, or for any permanent or temporary cessation in the provision of Family Tree Photo or any features thereof;

  • The deletion of, corruption of, or failure to store the User-Generated Content and other data maintained or transmitted by or through Family Tree Photo;

  • User’s failure to provide us with accurate personal data;

  • User’s submission and use of the User-Generated Content; or

  • Any reliance placed by the user on the completeness, accuracy or existence of any content, information, or recommendations featured on Family Tree Photo.

10.4. This Section 10 shall apply whether or not we have been advised of or should have been aware of the possibility of any such losses arising.

11. INDEMNIFICATION

11.1. The user agrees to indemnify, defend and hold us, our subsidiaries, affiliates, partners, officers, agents, contractors, licensors, service providers, subcontractors, and suppliers harmless from any claim or demand, including attorneys’ fees, made by any third party due to or arising out of user’s breach of these Terms, user’s access and use of Family Tree Photo, or user’s violation of any law or the rights of a third party, including intellectual property rights.

12. SEVERABILITY

12.1. In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such a provision shall nonetheless be enforceable to the fullest extent permitted by the applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. The validity and enforceability of the remaining provisions shall not be affected as a result.

13. GOVERNING LAW AND DISPUTES

13.1. Governing law. These Terms shall be governed and construed in accordance with the laws of Bosnia and Herzegovina, without regard to its conflicts of law provisions.

13.2. Jurisdiction. The user agrees to resolve any disputes arising out of or relating to these Terms by means of negotiation with us. If the dispute cannot be resolved by means of negotiation, the dispute shall be submitted to an alternative dispute resolution (ADR) body.

13.3. Alternative dispute resolution (ADR). ADR body acts as an independent middleman between an Internet service provider and a customer when an initial complaint cannot be resolved. No legal assistance or representation is necessary for taking a case to an ADR scheme. The ADR body investigates complains by looking at consumer’s and Internet service provider’s arguments and comes to a decision it deems to be fair.

13.4. This Section 13 does not affect any statutory rights that the user is entitled to as a consumer.

14. MISCELLANEOUS

14.1. Term and termination. The Terms enter into force on the date indicated at the top of the Terms and remain in force until updated or terminated by us or until the user stops using Family Tree Photo.

14.2. Amendments. We reserve the right to modify these Terms at any time, effective upon posting of an updated version on Family Tree Photo. Such amendments may be necessary due to the changes in the requirements of laws, regulations, new features of Family Tree Photo, and our business practices. We will send a notification through Family Tree Photo about any material amendments to the Terms. User’s continued use of Family Tree Photo after any changes shall constitute user’s consent to such changes. We also reserve the right to modify the services provided through Family Tree Photo at any time, at our sole discretion.

14.3. Breach of the Terms. If we believe, at our sole discretion, that the user violates these Terms and it is appropriate, necessary or desirable to do so, we may:

  • Send the user a formal warning;

  • Temporarily or permanently prohibit the use of Family Tree Photo;

  • Report the user to the relevant public authorities; or

  • Commence a legal action against the user.

14.4. Transfer of rights. The user is not allowed to assign user’s rights under these Terms. We are entitled to transfer our rights and obligations under these Terms entirely or partially to a third party by giving a prior notice. If the user does not agree to the transfer, the user can terminate these Terms with immediate effect by and stopping to use Family Tree Photo.

14.5. Merger or acquisition. In the event our business, during the term of these Terms, is acquired, merged, or sold, these Terms shall not automatically be terminated and we agree to use our best efforts to ensure that the transferee or surviving entity shall assume and be bound by the provisions of these Terms.

14.6. Entire agreement. These Terms, together with the documents referred to therein, represent entire agreement between the user and us regarding user’s relationship with us and govern the use of Family Tree Photo.
